Search for “CBD THC gummies” and you will find everything from lab-tested CBD supplements to illegal cannabis sweets designed to look like well-known brands. They are very different products, with very different legal positions in Ireland. This guide explains the difference, the risks, and how to choose a safe, legal CBD gummy.
The short answer
- CBD gummies contain cannabidiol, which does not cause a high. THC-free CBD gummies are widely sold in Ireland as food supplements.
- THC gummies contain tetrahydrocannabinol, the compound in cannabis that causes a high. They are illegal in Ireland.

CBD vs THC: what is the difference?
CBD (cannabidiol) and THC (tetrahydrocannabinol) are both cannabinoids found in the cannabis plant. They have a similar chemical structure but act very differently in the body. THC is intoxicating: it causes the “high” associated with cannabis. CBD is not intoxicating, which is why it is sold as a food supplement.

Why THC gummies are illegal in Ireland
THC is a controlled drug under the Misuse of Drugs Act 1977. According to the Food Safety Authority of Ireland, food products containing THC at any level are treated as controlled drugs. There is no legal threshold for THC in food, except the strict EU limits for hemp seed products. In 2024 and 2025 the Irish courts confirmed that any preparation containing THC is a controlled drug, whatever the proportion.
So whatever a website or social media seller claims, and however “natural” or “legal” the packaging looks, a THC gummy is not legal in Ireland.
The risks of cannabis sweets
Illegal THC gummies carry real risks beyond the law:
- Unknown strength. Seized products have been found to contain far more THC than their labels claim, and strength can vary from one sweet to the next.
- Delayed effects. Edibles can take an hour or more to work, so people often take more, then feel very unwell when it all kicks in.
- Copycat packaging. Many are packaged to look like popular sweets or crisps, which makes them easy for children to eat by mistake.
- No quality control. They are made without any safety checks.
The HSE has warned the public about cannabis edibles that look like sweets, after people, including children, needed hospital treatment. If anyone, especially a child, eats one by mistake, get medical help straight away.
HHC, THCP and Delta-8 gummies
As THC is illegal, some sellers now offer gummies made with semi-synthetic cannabinoids such as HHC (hexahydrocannabinol), THCP or Delta-8 THC, often marketed as “legal” alternatives. They are made in a lab, can produce a strong high, are not approved for food, and several have been brought under drug laws across Europe. They are not CBD products, and we strongly advise avoiding them. In Ireland, HHC has been a controlled drug since 29 July 2025.
What about “full plant” CBD gummies?
Some CBD gummies are made with whole-plant hemp extracts, which can contain small amounts of THC alongside CBD. In many countries that is accepted, but because Irish law has no tolerance for THC in food, these products carry more risk here. How CBD gummies are made
A CBD gummy is made much like any other gummy sweet. A gelling agent (gelatine, or pectin in vegan versions) is heated with sugar or a sweetener, flavours and colours. A measured amount of CBD extract is mixed in, and the mixture is poured into moulds, set, and coated. The key quality step is making sure every gummy in a batch contains the same amount of CBD, which is checked by laboratory testing.
The CBD extract itself starts as EU-grown industrial hemp. It is extracted, refined and tested before it goes anywhere near a gummy. For a THC-free gummy, the extract is processed to remove THC, and the finished batch is tested to confirm it.

- A real company with an address in Ireland or the EU.
- No medical claims.
- Sensible packaging: a sealed tub with a batch number and best-before date, not packaging that looks like children’s sweets.
- No mention of THC, HHC, THCP, Delta-8 or “cannabis gummies”.
